Family awarded $90M in wrongful death of 13-year-old daughter Ashley Davis, A family awarded $90M for the wrongful death of their 13-year-old daughter didn’t look for money but justice. “I didn’t ask anyone to give me any money or anything like that. I just want someone held responsible for what happened to my daughter,” said the 13-year-old girl’s mother Nycole Davis according to a NBC Washington report on April 16, 2013.

No money in the world can bring back Ashley Davis who would have graduated this year and would have been going to her prom.

On Sept. 1, 2009, 13-year-old Ashley Davis was a Crossland High School freshman. “She was on her way. She was doing the right thing. She was going to school. She was a good girl. She didn’t deserve this,” said Ashley Davis’ mother.

Ashley did what she was supposed to do. She went to school on the morning of Sept. 1, 2009.

What Ashley’s school didn’t do is follow their own policy to provide safe transportation for the students. According to the safe transportation policy adopted by the school board, Ashley was supposed to be picked up on her side of the street.

Since the policy never went into effect, Ashley had to cross Brinkley Road in Prince George's County in Maryland in order to get to her school bus stop.

While crossing the street to get to her school bus stop, a Lincoln Continental hit the 13-year-old girl as her classmates “watched in horror.”

Ashley suffered severe injuries and died two weeks later.

On Monday, in a civil trial, a six-person jury awarded the family $90M in damages, as well as medical and funeral expenses.

In response to Monday’s result of the wrongful death suit against the Prince George’s County School Board, the school board told NBC Washington that in fact “No judgment has been entered in this case. It is still under litigation.”

Since there are limits on the amount of money that a school system can be sued for, the legal battle will most likely continue.

What does not have to continue is having to find someone who is found responsible for the death of Nycole Davis’ daughter. Six jurors have taken care of that by awarding the family $90M.
